Terms and Conditions of Service

By using this site and making use of PandaFan, a service offered by Beexio B.V. and its subsidiaries ("the Company"), you agree to abide by the following Terms and Conditions. These Terms and Conditions cover all present and future features offered by your PandaFan account, individually and collectively referred to as the "Service".

About "the Company"

Depending on your account type, location, and the type of service you have purchased, the entity providing services to you may be either the company itself or its affiliated subsidiaries.

In these terms, "Company" refers to the actual entity that provides services to you. The company that ultimately provides services to you is determined by the billing information at the time of your payment. You can view your billing information on your account page to obtain details about the company.

Users of the Service

This Service is provided exclusively to individuals who are at least 13 years of age or to minors who have obtained parental or legal guardian consent to open and maintain an account.
This Service is provided exclusively to persons. Accounts registered by "bots" or automated methods are not authorized and will be terminated.
Each user is solely responsible for all of their actions related to the using the Service.

This service cannot be used in the Philippines, Cambodia, Laos, Thailand, and other Southeast Asian countries.

Usage Policy and Prohibited Activities

The Service cannot be used for activities prohibited by Dutch law and your local law. To protect its services from being misused, abused, or being used to harm someone, the Company enforces some rules which apply to every user equally, regardless of the type of subscription. You expressly agree not to use this Service for:

  • Accessing/sharing/downloading/uploading illegal content, including, but not limited to, child pornography or content perceived to be child pornography;
  • Harassing, abusing, insulting, harming, defaming, slandering, disparaging, intimidating, or discriminating based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
  • Sending or transmitting unsolicited advertisements or content ("Spam") over the Service, via e-mail or any other communication channel;
  • Attempting to access, probe, or connect to computing devices without proper authorization (i.e., any form of "hacking");
  • Infringing upon or violate our intellectual property rights or the intellectual property rights of others;
  • Any activities that may disrupt the Service (i.e., crawlers, running TOR bridges, or mainly for the use of any other automated program);
  • Promoting illegal activities or providing means for/helping other people commit unlawful activities by providing instructional information;
  • Abusing Unlimited Data by using more than 500GB of data within a calendar month without permission;
  • Share your account with others or any form of shared purchase of Service with others;
  • The number of simultaneous online devices exceeds the limit set by the Service;
  • Use the Service on a device that you do not own the right to use;
  • Share the Service with anyone other than your family under the same roof;
  • Share the Service with more than 1 family member under the same roof;
  • Use the Service for any commercial purpose without our permission.

The account of any user involved in any of the activities mentioned above will be suspended immediately. Additionally, you may be held responsible for any damages incurred by the Company, including any amounts charged by any outside entity due to said violation(s), without limitation attorney's fees and costs.

Limited Warranties and Liability

The Company does not make any warranty about the reliability of the Service. It does not guarantee the security of user data despite best efforts. The Service is provided "as is" and you agree neither to hold the Company responsible nor to seek indemnification for any damages that may arise as a result of the loss of use, data, or profits connected to the performance of the Service or failure in such performance.

The Company does not control, nor is responsible for, any data, content, services, or products (including software) that you access, download, receive or buy while using the Service. Furthermore, you will not hold the Company liable or seek indemnification if confidential material is unintentionally released as the result of a security failure or vulnerability in the Service.

The Company will attempt to make the Service available at all times; however, service coverage, speeds, server locations, and quality may vary. The Company is not responsible for data, messages, or pages lost, not delivered, delayed, or misdirected because of interruptions or performance issues with the Service or communications services or networks. The Company may impose usage or service limits, suspend Service, or block specific usage at our sole discretion.

The Company is not responsible for any inability to use the Service due to the customer's equipment, resources, or other third-party factors. For example, inability to obtain a non-Chinese Apple ID to download the App.

The PandaFan website may contain links to other websites of interest. However, The Company is not responsible for the content of any website it links to, and external sites are governed by their terms and conditions and privacy policies.

The Company may make improvements and changes to the Service at any time without notice. The Company may, at its sole discretion, terminate Service without cause or notice.

Indemnification

You agree that the Company and any parents, subsidiaries, employees, or third-party contractors cannot be held responsible for any third-party claim, demand, or damages, including reasonable attorneys' fees, arising from your use of this Service.

Privacy policy

PandaFan's Privacy Policy explains how the Company handles and protects your personal data and privacy concerning your use of the Service. By using the Service, you agree to our Privacy Policy.

General terms of payment

All services provided by PandaFan are one-time payments, and you only pay for the number of months of service you want. The service will not be automatically renewed upon expiry using your previous payment method, and no subscription needs to be canceled.

The Company reserves the right to discontinue service immediately if a fraudulent payment is detected, such as using a stolen credit card. Such cases may be further referred to the competent authorities.

Money-Back Guarantee

Suppose you cannot use the Service due to the Company's fault. In that case, you may cancel your account with a refund of the Service within 24 hours of your first initial purchase when at most 100MB of data usage. Refunds or credits beyond the 24 hours window will be considered but at the sole discretion of the Company. The Company is only obligated to refund in the original payment currency, and refunds will be processed within 30 days of the request. Please contact us via the support pageto request a refund under our Money Back Guarantee. This money-back guarantee clause is only applicable to users who have subscribed to PandaFan directly through the official PandaFan (e.g., if you have subscribed to PandaFan through the intermediary of a third-party processor, please refer to its respective refund policy).

Requests for refunds for inability to use the Service due to your equipment, resources, or other third-party factors that are not the Company's fault may be considered, but at our sole discretion—for example, inability to obtain a non-China Apple ID to download the App.

At its sole discretion, the Company may also provide the account holders with a prorated refund for service fees paid during the period the Service was not available or usable upon the account holder's request.

The payment processing fee charged by our payment processor will be deducted from your refund.

Referral/Promotion Rewards

Referral/Promotion Rewards are strictly subject to availability. Referees have to be unique users who have never purchased the Service.

Referral/Promotion Rewards are non-transferable, non-negotiable, and non-refundable and have no cash alternative.

The Company reserves the right to cancel any Referral/Promotion Reward without notice if it determines the Referrer/user engaged in: (i) fraud or abuse of the promotion or the Service; (ii) the referee has requested a refund or abuse of the Service.

Modifications to Terms of Service

You are responsible for regularly reviewing these Terms and Conditions. Within the limits of applicable law, the Company reserves the right to inspect and change these Terms and Conditions at any time. Continued use of the Service after such changes shall constitute your consent.

The Company reserves the right, at its absolute discretion, to modify the Service, for example, by adding or removing certain functions of servers or by updating the software.

At its sole discretion, the Company may provide limited technical support, upgrades, and updates for the Service. To enhance and further develop the Service, the Company may automatically download and install updates and upgrades from time to time. You, as a user, agree to receive such updates and upgrades as part of your use of the Service.
